Harriet Miers
I wrote this a couple days ago, but it seems worth returning it to the top:
Behold Harriet Miers, the current leading name for O'Connor's vacancy and so complete a sycophant that David Frum thinks her an apparatchik...
Harriet Miers is a capable lawyer, a hard worker, and a kind and generous person. She would be an reasonable choice for a generalist attorney, which is indeed how George W. Bush first met her. She would make an excellent trial judge: She is a careful and fair-minded listener. But US Supreme Court?
In the White House that hero worshipped the president, Miers was distinguished by the intensity of her zeal: She once told me that the president was the most brilliant man she had ever met. She served Bush well, but she is not the person to lead the court in new directions - or to stand up under the criticism that a conservative justice must expect.

I would think we would want to avoid the type of people that would result in something like Bush v. Gore. Not because it was a bad decision (I actually don't think it was), but because it was done for the wrong reasons. It was done to give Bush the White House.
That said, their conclusion that differing margins of error causes an equal protection problem IS accurate. It's just that they should have made it precident, and allowed probably about half (and most of the national races), to be challenged successfully, and sent back to the voters after the EP problem was handled.

Why must a conservative be open to any more criticism than a liberal? I bet more Americans have problems with Ruth Bader Ginsberg's views than they do with the views of John Roberts.

Right on, especially since Justice Roberts apparently has no views whatsoever on anything. Whereas every time I get my car's oil changed, the customers are grousing about that damned Ruth Bader Ginsburg and her views of jurisprudence.
However, Cap'n, you aren't really questioning why David Frum would expect a conservative justice to be more open to criticism, are you? Conservatives, especially religious conservatives, are martyrs, suffering for their beliefs at every turn, hiding their Bibles and Heritage Foundation talking points from confiscation by powerful liberals. If only conservatives absolutely controlled every single aspect of society; then they would be free to be...whiny martyrs.

Well, I obviously wasn't talking about Justice Roberts playing the "martyr" card, since to his credit he didn't buy into the Republican line about Democrats being anti-Catholic over judicial nominations. No, I was referring to the quoted David Frum piece, where he notes that Miers lacks the chops to stand up to the criticism that a conservative justice must expect. See, David Frum is not a liberal. That's important to understanding the meaning of this part of his piece, which is that conservative justices get criticized a lot. Boo hoo. Then someone, I can't quite remember who...Oh well, it'll come back to me, like Justice Ginsburg's name...Anyway, this person then jumped into the comments section and said,

Judge Roy Moore and his self-glorifying graven monument haven't been separately roaming the country, playing to crowds wallowing in their victimhood? Justice Sunday I and II weren't full of conservative self-identified Christians complaining about the tyranny opressing them? All righty, then. Since you say so. Though I'm curious why you're eager to defend the relgious right from stereotyping, since it's not stereotyping to note that they frown upon illegal drug use. But I'll try to avoid stereotyping in the future, even though the 34 percent of self-identified conservatives in this country apparently have a single monolithic set of beliefs.

What's important is to spread the word that she's a female Gonzales -- which she is: a Bush loyalist of no great distinction -- to piss off the judges-obsessed religious-right base.
Note: I'm not saying she is a closet liberal or that Democrats shouldn't oppose her or whatever; I'm just saying that she's not what Bush's base was expecting and it has the potential to make them really mad.

Can we get over this? I heard the same thing about Roberts and then Dobson said he was the cat's meow. I am certain these people(Roberts & Meirs) have been saying things at the dinner table they would not say in public and conservatives have absolute confidence in how they will rule. Dobson and crew may express doubts and dissatisfaction for public consumption, but if they really had doubts you would know it.
Bush promised more Scalias, and he is appointing them. Do not doubt it for a second.

Not the same thing. Roberts was a favorite of the social-conservatives in advance; Ramesh Ponnuru, the super-Catholic, super-right-wing guy at National Review named Roberts as his favorite candidate for SCOTUS. There may have been a few conservatives who hadn't heard about him and were therefore worried, but the right-wingers who knew about him knew he was one of them.
Miers, on the other hand, has been the subject of all kinds of warnings from the same crowd: don't draft her. The Powerline guys (the Powerline guys!) hate the pick. Kathryn Jean "Psycho" Lopez has qualms. David Frum has been sounding alarm bells about the pick.
For all I know about Miers, she might turn out to be a right-wing favorite. The point is, right now she's nothing of the kind and Bush has sort of revealed his true colors -- as a hack who cares only about advancing other hacks -- to the people who, in the words of another commenter, sold their soul for "judges."
